1. Scope

These GTCS apply to all contracts via [www.nickylanzer.com], covering digital products and services.

2. Contract Conclusion

The contract is valid upon order confirmation via email.

3. Prices & Payment

Prices in EUR incl. VAT. Payment in advance. Mentoring requires a €50 deposit.

4. Delivery & Services

Digital products via link/email. Workshops and Mentoring require registration and payment.

5. Usage Rights

Non-exclusive, non-transferable rights. No sharing or commercial use without written consent.

6. Warranty & Liability

Liability limited to contract value. No liability for indirect or consequential damages.

7. Data Protection

Data is handled confidentially and in accordance with GDPR, used only for contract purposes.

8. Withdrawal & Cancellation

Digital Products: No withdrawal after download.
Workshops:

• up to 4 weeks before: free

• up to 2 weeks: 25 %

• up to 1 week: 50 %

• within 7 days: 100 %
  Mentoring:

• free cancellation up to 24h

• after: deposit retained

9. Amendments

Terms may change. Latest version applies as published on the website.

10. Jurisdiction

Jurisdiction: Empoli (FI), Italy. Italian law applies.

1. Scope of Application

These General Terms and Conditions of Sale (GTCS) apply to all contracts concluded between Nicky Lanzer (hereinafter referred to as the „Seller“) and her customers (hereinafter referred to as the „Client“ or „Clients“) through the website www.nickylanzer.com.
These GTCS govern the sale of digital products (Presets and Storyboards) as well as the booking of services (Workshops and Mentoring).

2. Conclusion of Contract

The contract is considered concluded when the Seller receives the Client’s order via the website.
The order constitutes a binding offer. The contract is confirmed by an explicit email confirmation from the Seller.

3. Prices and Payment Terms

All prices are listed in euros and include applicable VAT, where relevant.
Payment must be made in advance via the payment methods specified on the website.
A deposit of €50 is required for mentoring sessions.

4. Delivery and Service Provision

Digital products (Presets and Storyboards) will be provided via download link or email following receipt of payment.
Participation in Workshops and Mentoring is subject to prior registration and full payment and takes place on the agreed date.

5. Usage Rights

By purchasing Presets and Storyboards, the Client acquires a non-exclusive, non-transferable right to use the materials for personal and commercial purposes.
Workshop and Mentoring content is intended solely for personal educational use.
Any distribution, publication, or commercial use without written permission from the Seller is strictly prohibited.

6. Warranty and Liability

The Seller ensures the proper provision of the services offered.
Any defects must be reported by the Client immediately.
The Seller’s liability is limited to the value of the contract.
Any further liability—particularly for loss of profits or indirect damages—is excluded to the extent permitted by law.

7. Data Protection

The Seller is committed to handling all personal data in accordance with applicable data protection laws, including the EU General Data Protection Regulation (GDPR – Regulation (EU) 2016/679).
Client data will be used exclusively for contract fulfillment and will not be shared with third parties, unless legally required or necessary for the execution of the contract.

8. Right of Withdrawal and Cancellation Policy

Digital Products (Presets and Storyboards):

There is no right of withdrawal once the download has started, as the product is provided digitally and delivered immediately upon contract conclusion (pursuant to Article 59, letter o) of the Italian Consumer Code).

Workshops:

• Cancellation up to 4 weeks before the event: free of charge

• Cancellation up to 2 weeks before: 25% cancellation fee

• Cancellation up to 1 week before: 50% cancellation fee

• Cancellation within the last 7 days: 100% cancellation fee

Mentoring:

Mentoring sessions can be cancelled free of charge up to 24 hours before the scheduled time.
If cancelled less than 24 hours before, the €50 deposit will be retained.

9. Changes to the GTCS

The Seller reserves the right to modify these GTCS at any time.
The updated version will be published on the website and shall apply to all future contracts from the date of publication.

10. Jurisdiction and Applicable Law

These terms are governed by the laws of the Italian Republic, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
The place of jurisdiction for all disputes arising from or in connection with the contract is the competent court in Empoli (FI), Italy, to the extent permitted by law.

By placing an order, the Client expressly agrees to these General Terms and Conditions of Sale.
